Office of the Comptroller of the Currency Rulemaking Hearing
The hearing focused on the technical and regulatory aspects of Class VI carbon capture and storage (CCS) permits, including expert testimony from Dr. Harvey. Key discussion topics included the role of pressure fronts in defining areas of review for injection sites, the potential for requiring automatic triggers for reevaluation, and the necessity of mandatory surface air monitoring. There was debate regarding whether proposed requirements like 10-mile radius evaluations for other injection projects should be mandatory or site-specific, and the expert's familiarity with EPA's historical rulemaking decisions on these matters was questioned.

Oil Conservation Commission Rulemaking Hearing
The hearing focused on rulemaking for geologic carbon sequestration. Key discussion topics included public concerns regarding alleged governor interference in regulatory processes and the admissibility of privileged communications. Expert testimony was provided on the physics of subsurface fluid flow, the inherent unreliability of reservoir simulation models for CO2 plume prediction, and the risks of CO2 migration through faults or caprock failures. The discussion emphasized the necessity of implementing conservative, enforceable safety protections and automatic, non-discretionary response protocols for carbon capture and storage projects to mitigate long-term environmental and safety risks.
